
Real Estate Sector Warns of Rising Property Seizures and Squatting Cases

An increase in cases of illegal occupation and seizure of private property in Tijuana and other regions of Mexico is raising alarms in the real estate sector, as the trend poses growing financial and legal risks for property owners and investors.
Lersa Mercadillo, a real estate advisor and former president of AMPI Tijuana, said the issue extends beyond vacant properties and is increasingly affecting rental units, where tenants stop paying rent and refuse to vacate the premises.
“This is a real and ongoing problem that directly impacts property owners, who may temporarily lose possession of their assets, resulting in financial losses and emotional strain,” Mercadillo said.
She explained that legal proceedings to recover property can be lengthy, often exceeding a year and, in some cases, lasting several years. These timelines include both the initial court case and the enforcement phase required to carry out an eviction.
According to Mercadillo, the complexity and duration of these cases highlight the need for more efficient legal mechanisms and expedited judicial processes that can resolve disputes more quickly and strengthen protections for property owners.
“Now more than ever, legal prevention is essential,” she said. “It is not enough to review a current contract. It is critical to analyze the origin of the property, its registry history, and its full legal traceability.”
Despite these challenges, Mercadillo noted that Tijuana continues to be an attractive destination for real estate investment, driven by its economic dynamism and ongoing urban growth. However, she stressed that investors and buyers must exercise greater caution.
She recommended conducting thorough legal due diligence and seeking professional guidance to ensure certainty in transactions and to safeguard assets.
Mercadillo added that, when approached responsibly, real estate investment in the city remains a sound decision, provided that buyers and property owners prioritize legal certainty and take the necessary steps to protect their investments.
