Baja California Lawmaker Proposes Legal Recognition of Dating Violence

State Rep. María Yolanda “Mayola” Gaona Medina has introduced legislation that would recognize violence in dating relationships as a specific form of violence under Baja California law, intending to strengthen legal tools to prevent, punish, and eradicate abuse in non-marital relationships.

The proposal, presented to the Baja California Legislature, calls for amendments to the state Penal Code and to the Law on Women’s Access to a Life Free of Violence for the State of Baja California. The initiative seeks to explicitly define and recognize violence in dating relationships, a situation the lawmaker said is not clearly addressed in current legislation.

According to the proposal, violence against women has persisted for decades and often begins during early romantic relationships rather than exclusively within marriage or family settings. The initiative notes that acts of control, manipulation, threats and various forms of abuse — including physical, psychological, sexual and economic violence — can occur during dating relationships even when partners do not live together or share a formal legal bond.

Gaona said the absence of an explicit reference to “dating relationships” in existing laws can create challenges in addressing such cases, as authorities must rely on broader interpretations of family violence provisions.

“In Baja California, the Penal Code and the Law on Women’s Access to a Life Free of Violence broadly contemplate family violence,” Gaona stated in the initiative’s explanatory memorandum. “However, it is necessary to expressly establish the term ‘dating’ and define it so that cases of violence occurring within affective or dating relationships can be addressed without requiring legal interpretation.”

The proposed reform would incorporate the concept of dating violence into the legal framework while maintaining consistency with existing definitions and principles related to family violence. Gaona said the initiative is designed to complement and harmonize current laws rather than duplicate or contradict them.

The measure aims to ensure that acts of violence occurring within dating relationships are clearly recognized by authorities and addressed through prevention and enforcement mechanisms already established in state law.

Gaona said recognizing dating violence in the legal framework could help authorities respond earlier to abusive behavior that may escalate if left unreported or untreated. The initiative also highlights concerns that patterns of abuse in early relationships may intensify over time and, in some cases, lead to more serious or fatal outcomes.

The proposal places particular emphasis on protecting young women and adolescents, who are often involved in dating relationships that fall outside the traditional definitions of family or domestic relationships used in current legislation.

According to the lawmaker, the reform seeks to guarantee women’s right to a life free from violence in all stages and forms of their relationships, regardless of whether a legal bond such as marriage exists.

Gaona said the initiative is also intended to align Baja California’s legal framework with constitutional mandates and international agreements that require governments to prevent, address and sanction gender-based violence.

“With this reform, Baja California seeks to address an urgent social reality,” the legislator said in presenting the proposal. “The goal is to strengthen the protection of young women and adolescents and fulfill the constitutional and international obligation to prevent and punish gender violence.”

The initiative has been submitted to the Baja California Legislature for review and consideration by legislative committees. If approved, the reform would add specific provisions related to dating violence within the state’s existing legal framework addressing violence against women.
