On August 1, 2023, Defendant Nicholas Hernandez Oceguera was sentenced to seven (7) years in State Prison for a felony violation of Penal Code sections 287(c)(2)(A) (forcible oral copulation) and 243.4(a) (sexual battery by restraint).
On approximately September 22, 2021, Jane Doe #1 went to the defendant’s home to get a massage – the victim and her family had been receiving massages from the defendant for years. This time, she went to his house alone, which was unusual for her.
At some point, the defendant sexually assaulted her. She immediately pulled up her shorts, ran out, screaming, and called her friend. Her friend called her mother and they immediately reported the incident to the Calexico Police Department. Eventually, a second victim came forward on October 6,
2021. Jane Doe #2 reported that she went to the Defendant’s house as well for a massage, alone. At some point during the massage, the defendant forcefully grabbed her, restrained her, and sexually assaulted her. She was able to free herself and run away but was too afraid to report the incident. Both victims described their experiences as being life-changing – they both reported the anxiety and depression and paranoia for them in being out and about in Calexico, where the defendant lives.
The case was handled and prosecuted by Deputy District Attorney Margaret Tafoya. The prosecution of this case would not be possible without the dedicated investigation of the Calexico Police Department Officers Luis Casillas and Michael Gonzalez. Imperial County District Attorney’s Office Victim Witness Program, in corroboration with District Attorney Investigators, provided resources to the victim to ensure their safety and security.
